1.1 These general terms and conditions (GTC) apply to the use of the website Simple-Staging.com and api.simplestaging.ut.in.ua.

1.2 Simple Staging, owner: Samuel Oberhand, Arndtstraße 3, 60325 Frankfurt am Main, offers services in the areas of virtual furnishing, renovation, clearing, visualizations, and floor plans.

1.4 The language of the contract and applicable law is German and the law of the Federal Republic of Germany.

2. Conclusion of Contract

2.1 The contract is concluded by the confirmation of the order by Simple Staging.

2.2 Simple Staging reserves the right to refuse orders without stating reasons. In this case, all payments already made will be fully refunded.

3. Scope of Services

3.1 Customers can choose between the services of virtual furnishing, renovation, clearing, as well as visualizations and floor plans.

3.2 Customers provide the necessary images, plans, and/or floor plans, as well as additional files required for processing.

3.3 The created files/floor plans are optimized for marketing purposes. We strive to make them as accurate as possible, but we do not accept liability for accuracy.

4. Usage Rights

4.1 Simple Staging retains the intellectual property rights to the created services. The customer receives a usage right for the promotion of the underlying object/property.

4.2 Simple Staging is entitled to use the created results on the website and in PDFs unless the customer expressly prohibits this in advance.

5. Cancellation

5.1 Cancellations are possible free of charge up to 24 hours before the agreed appointment.

6. Revisions

6.1 Revisions are included and can be requested within four weeks after receiving the first version.

6.2 Revisions refer to detail changes that the customer does not like and should be replaced.

6.3 Changes due to modified specifications or customer requests are not considered revisions and may incur additional costs.

7. Liability

7.1 Simple Staging is liable in the event of injury to life, body, or health for intent, gross and simple negligence. For other damages, Simple Staging is only liable in cases of gross negligence or intent and in the case of negligent violation of essential contractual obligations by its legal representatives or vicarious agents. Essential contractual obligations are those whose fulfillment shapes the contract and on which the customer may rely.

Simple Staging is not liable for damages resulting from the use of the created files/floor plans. Liability is limited to intent and gross negligence.

7.2 The customer is obliged to carefully check the delivered product before use to avoid misconceptions by third parties.

8. Data Protection

8.1 Customer data is stored and used exclusively for order processing in accordance with legal requirements.

9. Final Provisions

9.1 The law of the Federal Republic of Germany applies.

9.2 Should any parts of these GTC be ineffective, the validity of the other provisions shall remain unaffected. Invalid provisions will be replaced by legally permissible provisions that come closest to the economic purpose.
